The Legal Bit

Not quite as exciting as a double cheeseburger, but still important. Here you'll find the terms for using our website and ordering from us, together with information about your privacy, cookies and your rights.

Terms & Conditions Privacy Cookies Contact

Terms & Conditions

These terms apply when you use The Burger Brothers website and, where applicable, when you purchase food, drink or services from us.

1. About The Burger Brothers

This website is operated for The Burger Brothers. References to "The Burger Brothers", "we", "our" or "us" throughout this page mean The Burger Brothers.

The Burger Brothers
24 St Leonards Road
Bexhill-on-Sea
East Sussex
TN40 1HT
United Kingdom

Telephone: 07488 387079

2. Using Our Website

You may use this website for lawful personal purposes, including viewing our menu, finding information about the restaurant, contacting us and accessing online ordering services.

You must not deliberately:

  • damage, interfere with or disrupt the website;
  • attempt to gain unauthorised access to our systems;
  • introduce viruses, malicious software or harmful code;
  • use the website for fraudulent or unlawful purposes; or
  • reproduce or commercially exploit our content without permission where permission is required.

We may update, change, suspend or withdraw parts of the website where reasonably necessary.

3. Online Ordering

Links on our website may take you to a third-party online ordering provider, including Foodhub.

Where you order through a third-party service, your use of that platform will also be subject to the provider's own terms, privacy information, payment processes and procedures.

Submission of an order does not guarantee that it can be fulfilled. Orders remain subject to acceptance, availability, opening hours and any applicable delivery or collection restrictions.

We may reject or cancel an order where reasonably necessary, including if an item is unavailable, a genuine pricing error has occurred, payment cannot be authorised or the order cannot safely be fulfilled.

4. Prices, Menu Items & Availability

We aim to keep our prices, menu descriptions and other website information accurate. However, menu items, ingredients, recipes, prices, portion sizes and availability may change.

Prices displayed by a third-party delivery service may differ from prices available directly from the restaurant because of delivery charges, service fees, platform pricing or promotions.

Photographs are intended to give a representation of our products. Because our food is freshly prepared, appearance and presentation may vary.

5. Collection & Delivery

Any collection or delivery time given is an estimate. Times may change during busy periods or because of traffic, weather, demand or circumstances outside our reasonable control.

Customers are responsible for providing correct contact, delivery and collection information when placing an order.

Where delivery is provided through an independent delivery service, the delivery may also be subject to that provider's own terms and processes.

6. Allergies & Dietary Requirements
Important Allergy Information If you have a food allergy, intolerance or other dietary requirement, please tell us before ordering.

We handle a range of ingredients within our kitchen. Although we take reasonable precautions and follow appropriate food-safety procedures, cross-contact may be possible where multiple allergens are handled in the same environment.

Please do not rely solely on a menu name, photograph or general product description when deciding whether an item is suitable for a particular allergy.

Contact our team before ordering if you require allergen information.

Where you place an order through a third-party ordering platform, please also use any allergy or dietary information options supplied during the ordering process.

7. Alcohol Sales

Alcohol may only be purchased by people aged 18 or over.

Age verification may be required before alcohol is supplied. Suitable photographic proof of age may be requested.

We reserve the right to refuse the sale or supply of alcohol where identification requirements are not satisfied or where refusal is required by law, licensing obligations or our responsible retailing procedures.

8. Cancellations, Refunds & Order Problems

Our food is freshly prepared and is generally perishable. As a result, the cancellation rights that apply to some other types of online purchase may not apply in the same way to prepared food orders.

If you need to cancel an order, please contact us or the relevant ordering platform as quickly as possible. Once preparation has started, cancellation may not be possible.

If an order is incorrect, incomplete, damaged or otherwise not as expected, please contact us or the platform through which you ordered as soon as reasonably possible.

Nothing in these terms affects your statutory consumer rights.

9. Events & Burger Van Bookings

Sending an event, catering or burger van enquiry does not by itself create a confirmed booking.

Event bookings remain subject to availability and may be governed by additional terms agreed with you, which may include pricing, deposits, cancellation arrangements, timings, minimum spend requirements and venue requirements.

A booking will only be considered confirmed once confirmation has been provided by The Burger Brothers in accordance with the arrangements agreed with you.

10. Promotions & Offers

Promotions, offers and discounts may be subject to separate conditions, dates, product availability and minimum spend requirements.

Unless expressly stated otherwise, promotional offers may not be used together.

We may amend or withdraw a promotion where reasonably necessary, without affecting rights already acquired by a customer.

11. Intellectual Property

Unless otherwise stated, The Burger Brothers branding, logos, photographs, graphics, menu descriptions, written content and other original materials appearing on this website belong to us or are used with permission.

They must not be commercially reproduced, republished or exploited without permission except where permitted by law.

12. Third-Party Websites

Our website may contain links to services operated by other businesses, including ordering platforms, social networks and review websites.

Those services operate independently from us. Their use may be subject to their own terms, privacy notices and cookie policies.

We are not responsible for the operation, availability, security or content of independent third-party websites.

13. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

To the extent permitted by law, we are not responsible for loss caused solely by circumstances outside our reasonable control or by independent services that we do not operate.

Nothing in these terms removes any rights available to consumers under applicable law.

14. Governing Law

These terms are governed by the laws of England and Wales.

Consumers will continue to benefit from any mandatory rights available to them under applicable consumer law.

Privacy Policy

This section explains what personal information we may collect, what we use it for and the rights you may have in relation to it.

1. Who Is Responsible For Your Information?

Where The Burger Brothers collects personal information directly, we are responsible for determining how that information is used.

You can contact us regarding privacy matters using the contact details at the bottom of this page.

Independent services such as online ordering platforms may separately be responsible for personal information they collect from you directly.

2. Information We May Collect

Depending on how you interact with us, personal information may include:

  • your name;
  • telephone number;
  • email address;
  • delivery or collection information;
  • information contained within an enquiry;
  • event or catering enquiry details;
  • correspondence with our team;
  • CVs and employment information where you apply for work;
  • information needed to investigate a complaint, refund or customer service matter; and
  • technical information about use of our website, such as device, browser, IP address and cookie data where applicable.

Where you order through an independent ordering platform, payment details may be collected directly by that provider rather than by this website.

3. How We Use Your Information

Personal information may be used to:

  • respond to enquiries;
  • provide products and services;
  • manage event and catering enquiries;
  • resolve complaints or order problems;
  • process job applications;
  • maintain appropriate business and accounting records;
  • protect our website and business from misuse or fraud;
  • understand and improve our website;
  • comply with legal obligations; and
  • provide marketing where we have an appropriate lawful basis for doing so.
4. Lawful Bases

UK data protection law requires an appropriate lawful basis for processing personal information.

Contract

Where processing is needed to provide something you have ordered or requested.

Legitimate Interests

Where processing is reasonably necessary to operate our business, respond to customers, protect our services or improve what we offer, provided your interests and rights do not override those interests.

Legal Obligation

Where information must be processed or retained to comply with applicable law.

Consent

Where you have actively agreed to a particular type of processing, including certain cookies or marketing where consent is required.

5. Who We May Share Information With

We do not sell your personal information.

Where reasonably necessary, information may be shared with organisations that help us operate the business, such as:

  • website hosting providers;
  • online ordering and delivery services;
  • payment providers;
  • IT and technical providers;
  • accountants or professional advisers; and
  • regulators or law enforcement authorities where disclosure is legally required.

Our website currently uses Squarespace technology and links to independent online ordering services.

6. International Transfers

Some technology providers may process information outside the United Kingdom.

Where personal information is transferred internationally, appropriate safeguards or other lawful transfer mechanisms should be used where required by UK data protection law.

7. How Long We Keep Information

We keep personal information only for as long as reasonably necessary for the purpose for which it was collected and to meet relevant legal, tax, accounting or regulatory requirements.

The appropriate retention period depends on the type of information and why it is held.

Information from unsuccessful employment applications would ordinarily only be retained for a limited period unless there is a valid reason or permission to keep it for longer.

8. Your Data Protection Rights

Depending on the circumstances, you may have rights including the right to:

  • request access to your personal information;
  • ask for inaccurate information to be corrected;
  • request deletion in certain circumstances;
  • request restriction of processing;
  • object to certain processing;
  • request data portability where applicable; and
  • withdraw consent where processing relies on consent.

These rights are not absolute and legal exemptions may apply.

To make a request, please contact us using the details below.

9. Complaints

If you have concerns about how your personal information has been handled, please contact us so that we can investigate.

You also have the right to raise a concern with the UK's Information Commissioner's Office.

Further information is available from ico.org.uk .

10. Security

We take reasonable technical and organisational measures designed to protect personal information from unauthorised access, loss, alteration, misuse or disclosure.

No internet-based service can guarantee absolute security, but appropriate steps should be taken by us and the service providers we use to protect information.

Cookie Policy

Cookies and similar technologies help websites function and, where permitted, can help website owners understand how visitors use their sites.

1. What Are Cookies?

Cookies are small pieces of information that may be stored on your computer, phone or other device when you visit a website.

Cookies and similar technologies can be used to remember settings, provide website functionality, keep services secure and measure website performance.

2. Essential Cookies

Essential cookies are used for functionality that is necessary for a website or service to operate correctly.

These may include cookies relating to security, basic website operation, privacy preferences or functionality specifically requested by a visitor.

Strictly necessary cookies do not generally require the same consent as optional analytics or advertising technologies.

3. Analytics & Performance Cookies

Where enabled, analytics or performance technologies may help us understand how people use the website, including which pages are viewed and how visitors navigate around it.

Where applicable law requires consent for these technologies, they should only be activated once the required consent has been obtained.

4. Third-Party Services

Our website may link to or interact with services operated by other companies.

Examples may include website hosting services, online ordering platforms, social media services, maps, embedded content or analytics providers.

Third-party services are responsible for explaining how they use any cookies or personal information collected through their own services.

5. Managing Your Cookie Choices

Where non-essential cookies requiring consent are used, you should be provided with a way to accept or reject them through the website's cookie controls.

You may also manage or delete cookies through your browser settings.

Disabling certain cookies may affect some website features.

Where cookie preference controls are available on the site, you can use them to review or change your choices.
